1. Agreement to Terms
These Terms of Service (“Terms”) form a binding agreement between you (“you,” “Customer,” or “Researcher”) and Orchid Atelier (“we,” “us,” or “Orchid Atelier”) governing your access to and use of the website located at www.orchidatelierco.com (the “Site”) and the purchase of any products offered through it. By browsing the Site, creating an account, or placing an order, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Site or purchase any product.
2. Eligibility
You may only use the Site and purchase products if you are at least 21 years of age, a resident of the United States, and legally able to enter into a binding contract. We do not knowingly sell to, or accept orders from, individuals outside the United States or under 21.
3. Products — Research Use Only; Not FDA Approved
All peptides, reference compounds, and related materials offered by Orchid Atelier are sold for laboratory research and evaluation only. They are not drugs, dietary supplements, food, cosmetics, or medical devices, and they have not been approved by the U.S. Food and Drug Administration or any other regulatory body for human or animal use. By placing an order, you represent that you are a qualified researcher and that the products will be handled, stored, and used in a controlled laboratory setting.
4. Shipping
We ship within the United States only. Standard shipping rates are calculated and displayed at checkout. We aim to process orders within one to three business days, but we do not guarantee specific transit times. Risk of loss and title to the products pass to you upon our delivery of the products to the carrier.
5. Returns and Damaged Shipments
Because our products are perishable laboratory materials, we do not accept returns for change of mind, incorrect ordering, or storage failures on the customer side. We will replace or refund products only in the event of verifiable shipping damage or fulfillment error. If your order arrives damaged, contact us within 7 days of delivery.
6. Pricing and Payment
All prices on the Site are listed in U.S. dollars (USD) and are exclusive of any applicable taxes, which are calculated at checkout. Payment is processed securely through Stripe; we do not store full payment card details on our servers.
7. Intellectual Property
The Site and all of its contents — including text, graphics, logos, product names, photographs, page layouts, code, and the “Orchid Atelier” brand — are the property of Orchid Atelier or its licensors and are protected by United States and international intellectual property laws.
8. Customer Accounts
To place an order you must create an account using a valid email address and provide accurate registration information. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.
9. Prohibited Uses
You agree that you will not, and will not permit any third party to: (a) use, administer, or distribute any product for human or veterinary consumption; (b) resell, repackage, or redistribute any product for human consumption; (c) misrepresent the nature or regulatory status of any product; (d) use the Site in violation of any law; or (e) attempt to interfere with the security of the Site.
10. Disclaimers and Limitation of Liability
The Site and all products are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, Orchid Atelier disclaims all warranties, express or implied. Our total aggregate liability to you shall not exceed the amount you actually paid for that order.
11. Indemnification
You agree to defend, indemnify, and hold harmless Orchid Atelier, its affiliates, and their respective officers from and against any and all claims, damages, losses, liabilities, costs, and expenses arising out of or related to your use of the Site or any product, your breach of these Terms, or any use of a product for any purpose other than legitimate laboratory research.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict-of-laws principles.
13. Changes to These Terms
We may revise these Terms from time to time. Your continued use of the Site after a revision becomes effective constitutes your acceptance of the revised Terms.
